Every Code-covered person takes all reasonable steps to prevent, and to respond to, all forms of violence against, and exploitation, neglect and abuse of, people with disability. For providers this includes a stated commitment to eliminating such harm, identifying and responding to incidents and reporting them to the NDIS Commission (registered providers under the reportable incident rules) and to police or other authorities as appropriate, and reducing and eliminating restrictive practices.

Every Code-covered person provides supports and services in a safe and competent manner, with care and skill. The provider makes sure workers have the training, competence and qualifications for the supports delivered, services follow relevant professional codes, work health and safety requirements are met, records are accurate and kept securely, and appropriate insurance is held; a worker works within their competence and raises gaps in training.

Every Code-covered person promptly takes steps to raise and act on concerns about matters that may affect the quality and safety of supports and services provided to people with disability. Providers foster an environment where participants, families, advocates and workers feel safe to complain or report, operate effective complaints and incident processes, investigate and take disciplinary action, and cooperate with external investigations; workers report concerns through the provider or directly to the Commission.

Code of Conduct s 6(1)(a)s 6(1)(a) Respect rights to freedom of expression, self-determination and decision-making

In providing supports or services to people with disability, every provider, key person and worker acts with respect for the person's rights to freedom of expression, self-determination and decision-making, in line with applicable laws and conventions (the UN Convention on the Rights of Persons with Disabilities among them). The Commission's guidance reads this as supporting people to make their own decisions, communicating in a form and language they understand so they can make their will and preferences known, and taking account of their values and beliefs, including culture, faith, gender identity, sexuality and age.
